CriticalPoint Partners, LLC and its affiliates (“CriticalPoint,” “we,” “us,” or “our”) values your privacy. This Privacy Policy (the “Policy”) explains how we handle your personal information on CriticalPoint’s websites, including criticalpoint.com, criticalpointpartners.com, and any redirected site (collectively, the “Sites”). This Policy applies to only to personally identifiable information (“Personal Information”) that you provide or we collect through our Sites. A separate privacy notice will apply if you provide personal information through other means. “Personal Information” excludes (i) publicly available information, as defined by law; and (ii) de-identified or aggregated information.
By using our Sites, you agree to the handling of your Personal Information as described in this Policy. Your use is also subject to our Terms of Use, including limitations on damages and dispute resolution, which are incorporated by reference. If you disagree with any part of this Policy, do not access our Sites.
We are an LLC established in the United States. Our registered office is at 2101 Rosecrans Ave, Suite 4255, El Segundo, CA 90245. We are the data controller for the purpose of the General Data Protection Regulation (the “GDPR“).
Read this Policy carefully to understand your rights and how we collect, use, and process your Personal Information.
1. INFORMATION YOU PROVIDE TO CRITICALPOINT
- Contact Information: You may submit Personal Information so we can respond to inquiries or provide information about our services. This may include contact details, like name, email, address, and phone number, and details about your inquiry.
- Communications: Any details you include in messages to us, such as subject lines and message content.
- Financial Advisory Services & Marketing: We may collect Personal Information from you related to our financial advisory and marketing activities.
- Employment Candidates: We may collect pre-employment information from you when you apply for a job or an internship. This includes name, email, phone number, and résumé.
- Text Messaging Service: You may provide Personal Information, including your mobile number, in connection with your use of our Text Messaging Service, as outlined in the SMS Terms of Use.
2. INFORMATION THAT CRITICALPOINT AUTOMATICALLY COLLECTS
We use cookies to collect Personal Information. Depending on your browser and settings, this may include:

Opting out does not stop all ads; you may still see contextual ads based on the site you are visiting. Opt-out might also fail if your browser blocks cookies.

CriticalPoint may obtain Personal Information about you from:

- Government Authorities: Government agencies or law enforcement to comply with laws, regulations, legal processes, or government requests; to enforce this Policy and the Terms of Use; to protect the security of our services; to prevent harm, fraud, or illegal activity; or in emergencies where safety is at risk.
- Third Party Advisory Partners: Partners involved in financial advisory activities and due diligence.
We may also disclose Personal Information for the following purposes:
- Operating Our Sites and Services: To support functionality and performance of our services.
- Marketing: To deliver relevant advertising on our Sites based on your interests.
- Fraud Prevention: To investigate and respond to suspected illegal or fraudulent activity, or to protect the rights and safety of users and CriticalPoint.
- Legal Compliance: When required by law or to defend legal claims, protect our rights, or comply with a legal process like a subpoena or court order.
- Business Transfers: In case of a merger, acquisition, restructuring, or sale of assets, we may transfer Personal Information to buyers, lenders, auditors, legal, or financial advisors.

CriticalPoint does not sell Personal Information. We also do not share Personal Information for cross-context behavioral advertising purposes. We disclose your Personal Information only as outlined in this Policy.

Our Sites may include links to third-party websites or applications. These third-party websites or applications are governed by their own privacy policies, not this Policy. We are not responsible for such third parties’ data practices. Before sharing any Personal Information with a third party, review their privacy policy and take appropriate steps to protect your information.
8. RETENTION
We retain Personal Information only as long as necessary, in accordance with our data retention schedules and applicable legal or contractual obligations. Information may be retained to comply with applicable law, fulfil contractual obligations, anticipate or manage legal matters, or support the delivery of our services.
9. NOTICE TO CALIFORNIA RESIDENTS
Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), California residents have specific rights regarding the collection and use of their Personal Information, as defined by the CCPA.
This section (a) applies only to California residents, (b) covers only Personal Information subject to the CCPA, and (c) supplements the practices described in our main Policy.

Your Rights
If you are a California resident, you may have the following rights regarding your Personal Information:
- Right to Access: You may request, up to twice per year, the following regarding Personal Information collected in the past 12 months:
- (a) categories of Personal Information collected;
- (b) sources of collection;
- (c) business or commercial purposes for collecting, selling, or disclosing that Personal Information;
- (d) categories of third parties to whom it was disclosed; and
- (e) a copy of your Personal Information we have collected.
- Right to Correct: You may request that inaccurate Personal Information be corrected.
- Right to Delete: Subject to certain conditions and exceptions, you may request that your Personal Information be deleted.
- Right to Opt-Out of Sale/Sharing: We do not sell your Personal Information. We do not share Personal Information for cross-context behavioral advertising purposes. During the past 12-months, we have not shared your Personal Information for cross-context behavioral advertising purposes. We have no actual knowledge of selling or sharing Personal Information of consumers under 16 years of age.
- Right to Non-Discrimination: You will not be discriminated against for exercising your privacy rights.
- Authorized Agent: You may appoint an authorized agent to submit requests on your behalf. To do so, provide us a written authorization that allows the authorized agent to act on your behalf.
Exercise Your Rights
To exercise your rights, email info@criticalpointpartners.com and state that your request concerns “California Privacy Rights.” Include your (a) first and last name; (b) birth date; (c) email address; and (d) residential or mailing address. We will verify your identity by matching this information with our records. We may request additional details if needed to verify or process your request. We will notify you if verification fails.
10. RESIDENTS OF EEA/UK AND OTHER U.S. STATES
If you’re a resident of the EEA or UK, you have the following additional rights:
- Access: Request a copy of the Personal Information we process about you. We may ask you to verify your identity.
- Correction: Request correction of incomplete or inaccurate data.
- Deletion: Request deletion of your Personal Information, subject to legal exceptions.
- Restriction: Limit processing if data is inaccurate, processing is unlawful, or no longer needed.
- Portability: Request a copy of your data in a structured, machine-readable format to transfer to another controller, if processing is based on your consent or a contract.
- Objection: Object to processing based on our legitimate interests. We will comply unless we have overriding grounds or need the data for legal claims.
- Withdraw Consent: Withdraw consent at any time, including opting out of marketing.
Depending on your U.S. state, you may have similar rights to those listed above:
- Access: Confirm whether we process your data and access it in a portable format.
- Delete: Request data deletion.
- Correct: Request correction of inaccurate information.
- Opt-Out of Targeted Advertising: Opt out of targeted ads, profiling, or the sale of your data.
To exercise your rights, email info@criticalpointpartners.com. If you are a UK/EEA resident, state that your request concerns “UK/EEA Privacy Rights.” And if you are a resident of another U.S. state, state that you request concerns the Privacy Rights of your state.
11. INTERNATIONAL TRANSFERS
Our Sites are hosted in the United States. Some CriticalPoint companies and contractors who process your Personal Information are also located in the U.S. and other countries. These countries may not offer the same data protection level as GDPR. When transferring Personal Information to such countries, we take reasonable steps to protect your data in line with this Policy and applicable data protection laws. This includes using EU Standard Contractual Clauses and/or the UK International Data Transfer Agreement/Addendum (or equivalent measures under applicable law).
12. CHILDREN
The Sites are not intended for users under the age of 18. We do not knowingly collect Personal Information from anyone under 18. If we learn that a submission came from a user under 18, we will delete the information promptly.
13. CHANGES
We may update this Policy at any time at our sole discretion. We will post any updates on this page along with the revised date. By continuing to use our Sites, you agree to be bound by any changes. Review this Policy periodically to stay informed of any changes.
